Terms of use

These terms govern your use of smartinfratech.com (the “Service”), operated by Smart Infratech, Inc. (“Smart Infratech”, “we”). They apply to every visitor. By using the Service you accept these terms; if you don't, please don't use it. Our products (TerrainPulse, SmartCompose.ai and SmartManage.ai) and any project work are covered by their own terms or written agreements, which take precedence over these terms for those products and services.

1. Information on this site

Content on the Service is general information about our company, products and services. It is not professional engineering, surveying or legal advice, and it is not an offer or a contract. Project figures describe specific past work and are not a guarantee of results on other projects.

2. Products in development

SmartCompose.ai and SmartManage.ai are in development. Screens shown on the Service are previews using example data. Features, availability, early-access terms and pricing may change, and applying for the founding partner program does not guarantee a place in it.

3. Intellectual property

The Service and its content, including text, graphics, logos and software, belong to Smart Infratech or its licensors and are protected by United States and international law. TerrainPulse, SmartCompose and SmartManage are names and marks of Smart Infratech. You may not use our names, logos or trade dress without our prior written consent. Other names and marks belong to their owners.

4. What you send us

If you send us information, feedback or materials, you confirm you have the right to share them. We may use feedback to improve our products and services without any obligation to you. We will handle personal information as described in our privacy policy.

5. Acceptable use

You agree not to use the Service to:

• Break any law or infringe anyone's rights, including privacy and intellectual property rights
• Send spam, or harass, threaten, defame or defraud anyone
• Probe, scan or test the Service for vulnerabilities, or attempt to gain unauthorized access
• Introduce malware, or disrupt or overload the Service
• Scrape or copy the Service by automated means, except for search engine indexing

We may block access to anyone who breaks these rules, and may take legal action where appropriate.

6. Links and third-party services

The Service links to sites and services we don't control, such as Wingtra, LinkedIn and webinar platforms. We are not responsible for their content, terms or privacy practices, and you use them at your own risk.

7. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. You use the Service at your own risk.

8. Limitation of liability

To the fullest extent the law allows, Smart Infratech and its officers, employees and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of or inability to use the Service, any third-party conduct or content, or unauthorized access to your information, whatever the legal theory.

9. Indemnification

You agree to defend and hold harmless Smart Infratech and its officers, employees and affiliates from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Service or your breach of these terms.

10. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to hello@smartinfratech.com with the work, the location on our site, your contact details and a statement of good-faith belief. We will review and respond promptly.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. We will first try to resolve any dispute informally and in good faith. If that fails, the dispute will be resolved by binding arbitration under the rules of a recognized arbitration organization, except that either party may seek an injunction in court to protect its intellectual property.

12. Changes and termination

We may change these terms or the Service at any time, and will update the date above. Continued use after a change means you accept the updated terms. We may suspend or end access to the Service at any time, without notice, including if these terms are broken.

13. General

These terms and our privacy policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it.
